1.About these terms
These are the summary terms on which private owners (“Owner Partners” or “you”) place vehicles with Mylz Auto (Pty) Ltd (“Mylz”) to be rented to Mylz's customers. They explain how the programme works so you can decide whether to apply.
Questions or applications: bookings@mylzrentals.co.za.
2.Nature of the relationship
- Mylz rents your vehicle to customers in its own name, as principal. Renters contract only with Mylz and have no direct relationship with you. You must not contact, accept bookings from or take payment from renters introduced by Mylz.
- You remain the owner (or the registered titleholder's permitted user, where the vehicle is financed) and registered owner of the vehicle. Mylz manages the vehicle on your behalf as set out in the Vehicle Management Agreement.
- The arrangement is not a partnership, joint venture, employment or agency relationship (other than to the limited extent the agreement authorises Mylz to act for you, for example in nominating drivers for traffic fines), and is not an investment scheme: income is not guaranteed and depends on bookings.
- If your vehicle is financed, you must have the financier's written consent to rental use where the finance agreement requires it.
3.Vehicle eligibility
Unless otherwise agreed in writing, a vehicle must:
- be no more than 5 years old (from first registration) and have travelled no more than 100 000 km when placed with us;
- fit our premium fleet profile (make, model, specification, colour and condition) as assessed by us;
- be roadworthy, with a valid licence disc and no outstanding licence fees, fines or warrants;
- have a full service history at an approved dealer or service centre, with no overdue services or open safety recalls;
- not have been written off or registered as Code 3 (rebuilt) or Code 4 (permanently unfit); and
- pass Mylz's pre-onboarding inspection, which may include an independent vehicle inspection and photographs.
Mylz may decline any vehicle at its discretion and may ask you to remove a vehicle that no longer meets these criteria.
4.Your obligations
You must:
- keep the vehicle roadworthy, licensed and registered, and renew the licence disc before it expires;
- provide the registration certificate, service book, spare keys, licence disc and other documents Mylz reasonably needs;
- pay for, or authorise Mylz to arrange and deduct from your statement, scheduled services, tyres, brakes and other wear-and-tear items and mechanical repairs not caused by renters, as set out in the Vehicle Management Agreement;
- ensure the vehicle is covered by appropriate insurance at all times: either your own comprehensive insurance that expressly permits the vehicle to be used for rental or commercial hire, or the fleet cover arranged by Mylz, as agreed in the Vehicle Management Agreement. Standard private-use policies usually exclude rental use — please check with your insurer or broker;
- disclose any finance, accident history, defects or claims affecting the vehicle;
- forward to Mylz, within 5 business days, any traffic fine, toll, licensing or legal notice received for the vehicle; and
- not use, lend or sell the vehicle during agreed rental periods, or remove or interfere with the tracking device.
5.What Mylz does
- Markets the vehicle and takes bookings, payments and deposits from renters.
- Vets every renter (identity, licence, selfie and liveness, blacklist and fraud checks) before handover, and enforces its rental terms, age and licence requirements.
- Hands over and receives the vehicle, with photographic condition reports and signatures at each handover and return.
- Cleans and valets the vehicle between rentals.
- Coordinates routine maintenance, licensing renewals and repairs with approved service providers, as agreed with you.
- Fits and monitors a tracking device, and manages roadside assistance, accidents, recovery and claims.
- Handles traffic fines by nominating or redirecting them to the responsible renter.
- Provides monthly statements and pays your share of rental income as agreed.
6.Revenue share, statements & payouts
- Your share of rental income — a percentage of net rental revenue, as defined in your Vehicle Management Agreement — is set out in that agreement. “Net rental revenue” generally excludes VAT, the tourism levy, refundable deposits, fuel, fines, damage recoveries passed to repairs, and pass-through charges.
- Agreed costs (for example cleaning, maintenance coordinated by Mylz, tyres, tracking and any fleet insurance premium) are deducted as set out in the agreement and shown on your statement with supporting invoices.
- Mylz provides a monthly statement showing each booking, revenue, deductions and your payout. Payouts are made by EFT to your nominated bank account within the period stated in your agreement (typically by the 15th of the following month), for revenue Mylz has actually received.
- Income depends on demand and is not guaranteed. Mylz sets rental prices, discounts and availability in its discretion.
- You may query a statement within 30 days of receiving it; Mylz will provide reasonable supporting records.
7.Damage, accidents & claims
Every rental is documented with handover and return condition reports and photographs. If the vehicle is damaged, stolen or involved in an accident during a rental, Mylz will notify you promptly, manage the incident, recover the applicable excess or other amounts from the renter under its rental terms, and lodge or assist with the insurance claim under the cover agreed in your Vehicle Management Agreement.
Repairs are carried out by approved repairers. The agreement sets out how insurance excesses, uninsured losses, loss-of-income during repairs and diminution in value are allocated between you and Mylz. Mylz will not settle a claim affecting your vehicle on terms that leave you worse off without consulting you.
8.Traffic fines & tolls
Fines and tolls incurred during a rental are the renter's responsibility. You authorise Mylz, as your operator or proxy, to nominate or redirect infringement notices to the renter under the AARTO Act or the Criminal Procedure Act and to deal with the issuing authority. You must forward notices promptly (see clause 4). Fines relating to periods when you or your nominee had the vehicle remain yours.
9.Your own use & blackout dates
You may reserve the vehicle for your own use (“blackout dates”) through Mylz, with the notice and maximum number of days set out in your agreement (peak-season blackouts may be limited). Confirmed renter bookings take priority over later blackout requests. During your own use, your own insurance and responsibility for fines apply, and the vehicle must be returned clean, fuelled and in the same condition.
10.Term & termination
- The agreement runs for the minimum term stated in it and then continues until terminated.
- Either party may terminate after the minimum term on at least 30 days' written notice. Confirmed bookings falling within the notice period will be honoured, or Mylz will arrange an alternative vehicle for the renter.
- Either party may terminate immediately if the other materially breaches the agreement and fails to remedy it within the time allowed, or if the vehicle is no longer roadworthy, insurable or eligible.
- On termination, Mylz returns the vehicle, keys and documents to you, removes the tracking device and its branding (if any), and pays a final statement after deducting amounts owed under the agreement.
11.Personal information (POPIA)
Mylz processes your personal information (identity, contact, banking, tax and vehicle details) to assess your application, perform the Vehicle Management Agreement, make payouts, and meet tax and legal obligations, as described in our Privacy Policy (POPIA). You will receive only the renter information needed to deal with a claim or legal process involving your vehicle, and must keep it confidential and process it only in accordance with POPIA. Tracking data about your own use of the vehicle is used only for security and agreed purposes.
12.Tax
You are responsible for declaring your income from the programme to SARS and for your own income tax. If your rental income (with any other taxable supplies) exceeds the compulsory VAT registration threshold, or you register voluntarily, you must register for VAT and give Mylz a valid tax invoice, and the agreement will deal with the VAT treatment of your payouts. Mylz will provide statements to support your tax returns but does not give tax advice; please consult a tax practitioner.
13.Liability
14.Disputes & governing law
Please raise any concern with your Mylz account manager or at bookings@mylzrentals.co.za; unresolved disputes are escalated to a director and then, if the Vehicle Management Agreement provides, to mediation or arbitration. The agreement is governed by the law of the Republic of South Africa and the courts of the Western Cape have jurisdiction. Where you are a consumer under the Consumer Protection Act, your rights under that Act are not affected.
